🚀 🏆 Spring Cleaning GDPR Challenge Day 2: [Privacy Policy Update]

    Hey, ADVOCATES, here we go… it’s Day 2 of the Fan List Spring Cleaning & GDPR Compliance Challenge.

    Are we having fun yet?

    Congrats to all the challengers who completed Day 1 and posted their Platform Action Plans.

    And a big shout out to any challengers who filled in any gaps in their platforms yesterday by implementing one of the platform elements they were missing with the help of our RESOURCE GUIDE.

    One thing that I love is the attitude so many creators are taking in the challenge… sure, this stuff is a pain in the rear to have to focus on, but if we choose to take this time to do some of those non-urgent but important things we’ve been putting off for too long, we can make this a real win.Now, bad news… today’s lesson and challenge is no fun.

    Good news, it’s super easy to do, you can do it once, and you’re done.

    (Well, until the next time there’s a big change like GDPR.)

    Day 2 – Privacy Policy Update

    If you’re in this challenge, you need an updated, GDPR-compliant privacy policy on your website and online shop, you need to link to that policy on all of your landing pages, and once it’s updated you will need to email your list a link to your updated policy.

    Sounds about as fun as a root canal, I know.

    Right now, you’re probably in one of two camps…
    Camp 1: You don’t have a privacy policy on your website and/or aren’t linking to a privacy policy on every one of your landing pages.

    Camp 2: You have a privacy policy on your website but it needs to be updated to become GDPR compliant.

    Whichever camp you’re in, we’ve got you covered.

    What To Include In Your Privacy Policy?

    By the new regulation, there are a lot of things your Privacy Policy needs to have in it… here are just a few:

    • The identity and contact information of the company collecting the info (you).
    • The identity and contact information of your GDPR representative (you).
    • The identity and contact information of your data protection officer if you have one. (You probably don’t need one. This is for the Facebook’s of the world.)
    • The reason for collecting and processing information.
    • How you will protect the data.
    • The period of time you will keep the data.
    • The user’s rights to request access, rectification, and erasure.
    • The user’s right to withdraw consent at any time.
    • The user’s right to lodge a complaint with a supervisory authority.

    Where To Include The Privacy Policy?

    Once you have created your Privacy Policy, you should create a standalone page on your website where you’ll post that policy.

    For example, here is ComixTribe’s updated, GDPR compliant privacy policy –> www.ComixTribe.com/privacy

    You should then include links to the Privacy Policy in your footer navigation menu, on your landing pages or anywhere you collect emails.

    After your privacy policy is live, you will need to email your updated privacy policy to your entire email list to inform them that you’ve made a change to it.

    Need Help Creating Your Privacy Policy?

    I get it.
    Creating a privacy policy kind of sucks… and most of us aren’t used to drafting legal documents like this.

    Here are three approaches you can take to getting your privacy policy.

    Option 1: Hire a lawyer to draft your privacy policy.

    This will cost you a few hundred dollars and you’ll need to act fast to get your GDPR compliant privacy policy ready before the deadline, but at least you’ll have the peace of mind knowing it was done right, and can talk to a human being if you have any questions.

    Option 2: Purchase a GDPR compliant Privacy Policy legal template.

    This is where you purchase a GDPR compliant legal template and then edit it yourself.

    These templates usually run anywhere from $100-$1,000 dollars.

    Here is a link to a GDPR website template pack from a lawyer whose primary business is selling legal templates and coaching entrepreneurs on how to fill them out themselves.

    It includes some step-by-step video coaching on filling out the Privacy Policy, plus, two other website templates that are good to have, and is only $150, which is less expensive than most of the GDPR compliant templates out there.

    Note: This is the option I used to create ComixTribe’s updated privacy policy.

    Option 3: Use a free GDPR compliant privacy policy template and edit it yourself.

    I was able to find one law firm in the UK that was offering a free GDPR compliant privacy policy template.

    There’s no training to go with it, the instructions are okay but not great, and you will need to join their email list to get it, but it is free and fairly straightforward to edit.

    Here is a link to opt-in and get the free GDPR privacy policy template from Net Lawman.

    Wait, Tyler, Can’t I Just Copy ComixTribe’s Privacy Policy and Swap In My Own Info?

    I wish I could tell you, “Sure, go ahead!”

    But I can’t.

    Simply copying a similar website’s privacy policy and posting it as your own is not legal.

    See, a privacy document is a legal, copyright protected document, drafted by lawyers… lawyers who have a vested interest in protecting their legal property, and have every right to go after businesses who are using their intellectual property without permission.

    Should you simply copy and paste copyrighted language without the appropriate usage rights and then post it on the internet as your own, you’re opening yourself up to potential legal action.

    Not worth the risk, in my opinion.

    Challenge 2 – Update and Publish Your GDPR-Compliant Online Privacy Policy

    1: Choose one of the options above to get an updated, GDPR-Compliant Online Privacy Policy.

    2: If you purchase or obtain a template, edit it with your own information.

    3. Publish on it’s own page on your website. Ex. [your website.com].com/privacy

    Done? Click here to share the link to your updated privacy policy in the private FB group to get credit for completing today’s challenge.

    4. Make sure your online shops and landing pages all include a link to your updated privacy policy.

    Note: You will also need to email your list about the privacy update, however, we’re going to do that later in this challenge.


    GDPR Connection (Day 2)

    Why do you even need a Privacy Policy?

    Well, one of the core principles of GDPR is transparency. Your Privacy Policy tells website visitors and prospective customers what information you collect, what you’ll do with it, and how you’ll protect it.

    There are lots of great things about creating art and doing business in 2018…

    This isn’t really one of them.

    But once you’ve checked this off your list, you can move forward with confidence and piece of mind that you’re doing things on the up and up.
